California father charged with murder after 100 mph crash killed son
A California man appeared in court Wednesday in a wheelchair, charged with murder in the alleged drunk driving death of his 16-year-old son earlier this month.“We take that extraordinarily seriously. But when you combine that with driving at this speed in a residential area, it constitutes murder,” Monterey County Chief Assistant District Attorney Berkley Brannon said.Prosecutors revealed new details about the crash, which occurred on Meridian Road. They said 37-year-old Edgar Banuelos was driving 100 mph in a 25 mph residential zone when he lost control of the vehicle, crashed into a tree, and the car burst into flames with his three children inside. The Monterey County District Attorney’s Office filed a complaint on Monday charging Banuelos Sr. with second-degree murder, gross vehicular manslaughter while intoxicated, and three counts of child abuse for endangering a child under circumstances likely to produce great bodily injury, according to the criminal complaint. “The car was going so fast, it became airborne over a small hill. He had three children in the car, three of his children. And he had alcohol in his system. And one of the kids, the 16-year-old, ended up burning in the car,” Brannon said. The son, Edgar Jr., a North Monterey County student, was killed in the crash. His 14-year-old and 7-year-old siblings survived. The children’s mother, Jessica Gonzalez, said, “Honestly, like, it breaks my heart to see that they’re charging him with murder. Honestly, Edgar has always been there for his kids. Banuelos has been charged with second-degree murder, gross vehicular manslaughter while intoxicated, and three counts of child abuse for endangering a child under circumstances likely to produce great bodily injury, according to the criminal complaint. Prosecutors said Banuelos showed a conscious disregard for human life.“This isn’t a story about, you know, driving under the influence, even. This is a story about just a willful and wanton disregard for human life,” Brannon said.“He was very close to his house. I mean, this was totally unnecessary,” they added.Edgar Banuelos remains in the Monterey County Jail, held on $1.4 million bail. He is due back in court next month.
