Charges not filed yet against alleged drunk driver accused of killing motorcyclist in Omaha

OMAHA, Neb. —
The Douglas County Attorney’s Office confirms no charges have been filed for Bailey Burr, 31.
The update comes a week after Omaha police say she was allegedly driving drunk when her vehicle and a motorcyclist collided near 144th and Corby streets.

The rider, Ryan Hay, died.
KETV checked the Douglas County Inmate Roster, and it shows Burr is no longer listed as an inmate.
Douglas County Attorney Don Kleine said that’s because Omaha police need more time to collect all the evidence.
“The police are still investigating,” Kleine said. “They’ve asked for a little more time with results from the toxicology and some other things they’re checking on. As soon as that’s complete, I anticipate they’ll be something that will be coming out. Let them get their job done and make sure we make the right call.”
On July 16, just after 12 a.m., Omaha police were called to 144th and Corby streets for a crash involving a motorcycle.
A crash report said Burr was turning left on Corby Street when the motorcycle operated by Ryan Hay collided with the back side of her vehicle.
Hay went to the hospital with CPR in progress and Burr was arrested for DUI after Omaha police reported she failed sobriety tests.
Kleine said Omaha police are waiting for toxicology reports from everyone involved in the crash.
It’s unclear when the charges will be filed and what charges Burr will face.
