According to an affidavit, a pickup driver told Bellevue police that Swigart waved a gun at him and shot his truck.
The victim, Damon McKee, told officers that it started when he noticed a gray Chevy pickup coming up behind him at a high rate of speed, according to court documents. McKee said the truck sped around him and tried to enter the lane in front of him.
The victim said he swerved to avoid a crash, but the gray truck continued to follow him, with the driver waving a handgun. McKee says that after Swigart side-swiped his truck, he heard a loud bang, and his back passenger window broke.
The affidavit states that the officer saw a bullet hole in the truck’s driver’s side window and a bullet entrance and exit hole on the bottom of the driver’s headrest.
When investigators went to speak with Swigart at his home in Plattsmouth, he allegedly told officers a red pickup had hit him and driven off. Swigart denied having a handgun and firing one at any vehicle, according to the affidavit.
Swigart’s sentencing is now set for Aug. 17.
