Court denies bond for suspect in deadly Omaha shooting, evidence investigators found

The man accused in a deadly shooting in Omaha was denied bond during a court appearance Wednesday.Denzel Gaines is charged with second-degree murder, two counts of use of a firearm to commit a felony, possession of a firearm by a prohibited person, and terroristic threats in the death of 21-year-old Mi’Kaya Eggert.He also has a prior criminal history, which includes an accessory to felony murder. On Sunday, officers found Eggert shot near 28th and Franklin streets. She was taken to Nebraska Medicine with CPR in progress during transport. She died from her injuries.Gaines was detained at the scene. According to the arrest affidavit, the moment officers arrived on scene, a witness told police Gaines shot her sister, Mi’Kaya Eggert.Previous coverage: One person dead after shooting in North OmahaAccording to court documents, Eggert’s injuries were caused by a gunshot, “likely a shotgun firing buckshot.”Witness interviews revealed in court said Gaines and Eggert were arguing in his home when he got his shotgun.“He pointed it at the victim’s sister, saying, ‘If it goes off, it goes off,’ and pulled the trigger. But the weapon didn’t fire,” the court prosecutor said. “The defendant then turned the shotgun to the victim, pulled the trigger again, and this time it did fire, killing the victim.” Douglas County Attorney Don Kleine said, based on the evidence at hand, the motive is clear.“When you point a loaded firearm at a person, you pull the trigger, I think that shows that you intended to kill them,” Kleine said.According to the affidavit, the initial search of the home revealed a loaded shotgun with blood on the muzzle “tucked” behind a bed on the first floor, “6 buckshot pellets” in the area where Eggert was found, and blood on Gaines’ right leg.“This is the initial charges we filed. We can always change that if we get other evidence, show something different,” Kleine said, and added they’re looking into the relationships between all parties.“There’s a lot of investigation going on,” he said. “If it’s domestic violence related, which it seems to be.”The affidavit said Omaha police arrived at the scene around 5 p.m., which OPD confirmed is accurate.But details about when the call was made to 911 remain unclear.Investigator notes detail a neighbor heard the shot at that same time, and that 20 minutes had passed before Gaines showed up asking her to call 911.Eggert’s sister also tried calling police during these 20 minutes.“I’m not sure what happened as far as why, the sister wasn’t able to get through to 911, and we’ll find out what the cause of the problem was there,” Kleine said.The judge ruled Gaines will be held with no bond.
